Booking Conditions 

1.1 By making a booking, the first named person (“Lead Passenger”) on the booking agrees on behalf of all persons detailed on the booking that: 

a. he/she has read these Booking Conditions and has the authority to and does agree to be bound by them; 

b. he/she consents to our use of personal data and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements); 

c. he/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services. 

1.2 Abeona Travel Co Ltd (the “Company”) does not itself own or provide any of the services, facilities or travel arrangements which make up your booking. These are provided by third parties with whom we arrange to provide the services, facilities or travel arrangements which make up your booking (the "Travel Providers"). 

1.3 All agreements with the Company are subject to these Booking Conditions, and are regulated by English law and the exclusive authority of the English Courts. However, if you reside in Scotland or Northern Ireland, you may initiate legal proceedings in your local court. The contract becomes effective once we send our confirmation receipt, and your deposit payment will signify your complete acceptance of these Booking Conditions. Please review the confirmation thoroughly and inform us immediately if any information is incorrect or incomplete. 

1.4 The Company will try to arrange for Special Requests, such as diet, room location, twin or double bedded room, a particular facility etc which are an important factor in the choice of holiday, to be met, but cannot guarantee that they will be, nor will the Company be liable if any Special Request is not met. The provision of any Special Request does not constitute a term of your contract with us. 

Accommodation Only Bookings 

2.1 When booking, you are required to pay a deposit of 25% of the total cost per person or a higher deposit if applicable to your accommodation. Certain accommodation providers may require larger deposits during peak periods, and we will inform you of this at the time of booking. If you book within 60 days of your departure date, full payment is required at the time of booking. Upon receiving your deposit, we will send a confirmation invoice outlining the remaining balance. The full payment must be made at least 60 days prior to departure. Failure to pay the full balance within 15 days may result in the cancellation of your travel arrangements and forfeiture of the deposit as a cancellation fee. 

2.2 Please be aware that the cost of your accommodation does not cover any additional chargeable services you may use during your stay. These extra services must be paid directly to the accommodation provider before your departure. 

Package Holidays 

3.1 Where we refer to “Package Holidays” in these Booking Conditions, we refer to a "Package" within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018 (the "Package Travel Regulations"). 

3.2 Prices set out in the proposal of travel arrangements are subject to increases or decreases, caused by suppliers’ dynamic pricing and changes in exchange rates. We aim to give you as accurate an indication of final price as possible prior to booking, but the final cost of your trip may vary slightly from the original final cost on the proposal. Once you have paid the deposit you agree to pay the final amount due on the invoice we issue to you, even if this varies from the final amount on the proposal. We will endeavor to give you as accurate an indication of the price of the whole booking at time of booking as possible. 

3.3 Please note that some travel products are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by Abeona Travel Co Ltd to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. You hereby consent to any post-purchase price increases and consent to pay any additional amounts due to Abeona Travel Co Ltd within 15 days of any invoice issued by the Company. 

3.4 Please note that changing any aspect of your travel arrangements after booking may require the payment of additional money and may also incur an amendment charge. You hereby consent to pay any additional amounts due to Abeona Travel Co Ltd for the changing of bookings within 15 days of any invoice issued by the Company. Please see the section on amendments below for more details. 

3.5 Please be aware that airlines and other transportation providers typically treat name changes as cancellations followed by rebookings, which may result in a cancellation fee of up to 100% of the fare. 

3.6 The Company is under no obligation to give a breakdown of the costs involved in a Package Holiday.

Changes, Transfers and Cancellations 

4.1 If you have booked a Package Holiday, you may transfer it to another person who meets all the applicable conditions. Both you and the new traveler must accept joint and individual liability for any remaining balance, fees, charges, or costs resulting from the transfer. This includes our administration fee (GB£100 or equivalent per person) and those of our Travel Providers. To transfer the booking, contact us and provide reasonable notice to allow us to make the necessary arrangements. Note that airlines may treat a transfer as a cancellation and rebooking, potentially incurring a cancellation fee up to 100% of the original flight cost, plus full payment for the new booking. The Company will pass these costs on to you and/or the new traveler. Additionally, some airlines may not allow flight transfers to another person, treating such requests as cancellations and prioritizing other customers for the available seat. In such cases, we will attempt to find an alternative flight for the new traveler, but the cost will be your and/or the new traveler’s responsibility. We will not offer refunds or compensation if changes to your booking result in unused elements, such as missing the first night of accommodation due to a later flight. 

4.2 If you wish to modify any part of your holiday arrangements after receiving the confirmation invoice, we will do our best to accommodate the changes, but it may not always be possible. Any change requests must be made in writing by the Lead Passenger. If the change can be made, you will need to pay an administration fee of GB£50 or equivalent for each element altered, plus any additional costs incurred due to the change. Be aware that these costs will likely increase as the departure date approaches. If you want to make changes after your travel arrangements have started, we will try to accommodate these requests at our discretion, and you will need to pay an administration fee of GB£100 or equivalent for each element changed, along with any further costs incurred. Note that altering one part of your travel arrangements may affect other parts, and the administration fee will apply to each element requiring a change due to the initial request. 

4.3 All cancellations must be advised in writing. Cancellations are effective on the date they are received by the Company. Since we incur costs in canceling your travel arrangements, the cancellation charges will depend on the terms of the Travel Provider or Accomodation. This applies to all cancellations, even if due to circumstances outside your control; the exception to this is in the case of Force Majeure events, as defined below. 

4.4 In these Booking Conditions, “Force Majeure events” refer to situations and the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare, serious security issues such as terrorism, laws or orders from a government or local authority, significant health risks like outbreaks of serious diseases (including pandemics or epidemics) at the travel destination, natural disasters like floods, earthquakes, or weather conditions that make safe travel to the destination impossible, or the insolvency of a Travel Provider (if no suitable alternatives are available). 

4.5 Except as otherwise set out in these Booking Conditions, we will not be liable to you for any failure to provide your travel arrangements, or for any changes or cancellations made, as a result of Force Majeure events. 

Cancellations by the Company 

5.1 As the Lead Passenger, your booking signifies your acknowledgement that the Company is neither the source nor the supplier of the travel services you have requested and serves solely as an agent for the actual suppliers of these services. You have been informed that the suppliers identified in the information provided to you are solely responsible for delivering the travel services you have purchased. You hereby consent to and request the use of these suppliers and agree to absolve the Company from any liability should any of these suppliers: 1) fail to deliver the travel services you have purchased; 2) fail to comply with any applicable laws; or 3) engage in any negligent act or omission resulting in injury, damage, delay, or inconvenience to you. 

5.2 We will not be liable to pay any compensation if we are forced to cancel or in any way change your travel arrangements as a result of Force Majeure events. 

5.3 In the case of changes to your accommodation to another of the same standard, alterations of your flights within a 12-hour period or similar such alterations (“Minor Changes”), you acknowledge that these are in control of the Travel Provider and the Company has no liability. In the case of a Significant Change, defined as a significant change of destination or accommodation to a significantly lower standard, you may be entitled to a price deduction or choice of alternative holiday. Whether you are entitled to terminate your holiday and receive a refund depends on the individual Travel Provider and circumstances. 

Miscellaneous 

6.1 The Lead Passenger acknowledges and agrees that it is a condition of booking that they obtain comprehensive travel insurance prior to the commencement of their travel. This insurance must cover, at a minimum, personal injury, death, medical expenses, repatriation costs, loss of luggage, and cancellation or curtailment of the holiday. Your insurance should also include cover against COVID-19 and other health related incidents which may affect or curtail your booking. You agree to provide proof of such insurance upon request by the Company. Failure to obtain adequate travel insurance will result in your assuming full responsibility for any costs or losses incurred and the Company will not be held liable for any claims or expenses that could have been covered by such insurance. 

Assignment 

7.1 You shall not assign, transfer, or subcontract any of your rights or obligations under these Booking Conditions without the prior written consent of the Company. The Company may assign, transfer, or subcontract its rights and obligations under the Booking Conditions at its discretion, provided that such assignment does not reduce your benefits or increase the obligations under this Agreement. Any attempted assignment in violation of this clause shall be null and void. 

Entire Agreement

8.1 These Booking Conditions set out the entire agreement and understanding between the parties in connection with the travel arrangements and supersedes any prior representations, agreements, conditions, negotiations and undertakings whether made orally or in writing.
